Thesis Abstract

The contemporary criminal justice paradigm has evolved over centuries, shaped by various historical, social, and political factors. This research explores the origins of this paradigm, tracing its development from early civilizations to the modern system in place today. By examining key historical events and influential figures, we aim to shed light on the foundations of our current understanding of criminal justice. One of the earliest influences on the contemporary criminal justice paradigm can be traced back to ancient civilizations such as Mesopotamia and Egypt. These societies developed rudimentary legal codes and systems of punishment to maintain order and regulate behavior within their communities. The concept of retribution, deterrence, and rehabilitation began to take shape during this time, setting the stage for future developments in the field of criminal justice. The Roman Empire also played a significant role in shaping the contemporary criminal justice paradigm. The Romans established a system of laws and courts that emphasized the importance of due process and the rule of law. The principles of equity and fairness in legal proceedings were fundamental to the Roman legal system and continue to influence modern concepts of justice. The Middle Ages saw the emergence of feudalism and the manorial system, which had a profound impact on the development of criminal justice. Feudal lords administered justice within their domains, often relying on trial by ordeal or combat to determine guilt or innocence. The church also played a prominent role in the administration of justice during this period, influencing the moral and ethical dimensions of criminal law. The Enlightenment era of the 17th and 18th centuries marked a significant shift in the contemporary criminal justice paradigm. Philosophers such as Cesare Beccaria and Jeremy Bentham advocated for the reform of criminal laws and the justice system, promoting the ideas of proportionate punishment, deterrence, and rehabilitation. Their writings laid the groundwork for modern theories of punishment and the principles of criminal justice that we adhere to today. In conclusion, the contemporary criminal justice paradigm has deep roots in history, with influences ranging from ancient civilizations to modern reformers. By understanding the origins of our current system of justice, we can gain valuable insights into the principles and values that underpin our approach to crime and punishment.
